Terms of Service

1. Acceptance of Terms

By accessing or using Forevibe, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

Forevibe is an AI-powered product planning platform that helps software builders create production-ready implementation plans. The Service includes:

• AI-generated implementation plans with phased delivery
• User story and technical story generation
• Blind spots detection and security review
• Gate enforcement and quality checks
• .forevibe build contract files and IDE rule files
• MCP server integration for Cursor, Windsurf, Gemini, and Claude Code
• Pay-as-you-go plan credits and optional monthly subscriptions

3. Account Registration

• You must provide accurate, complete registration information
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years of age to create an account
• One person may not maintain more than one free account
• You are responsible for all activity under your account

4. Intellectual Property

Your Content

You retain all rights to the product ideas, plans, stories, and other content you create using Forevibe. We do not claim ownership of your content. You grant us a limited licence to host, store, and process your content solely for the purpose of providing the Service.

Our Service

Forevibe, including its AI models, algorithms, user interface, documentation, and branding, is the property of Forevibe LTD and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to generate plans for illegal or harmful products
• Share your account credentials with unauthorised users
• Scrape, crawl, or automatically extract data from the Service
• Resell or redistribute the Service without written permission
• Use the Service to build a competing product

6. Subscription & Payments

• Forevibe offers a free tier (2 plan runs) and a paid monthly Starter plan ($10/month for 5 plan runs)
• Pay-as-you-go credits can be purchased at any time — $10 purchases 5 credits, credits never expire
• Payments are processed securely through Stripe — we do not store your card details
• Monthly subscriptions auto-renew unless cancelled before the renewal date
• You may cancel your subscription at any time from your account settings
• One-time credit purchases are non-refundable once credits have been used
• Unused credits on monthly plan cancellation are non-refundable unless required by applicable law
• We reserve the right to change pricing with 30 days' notice

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will provide advance notice for planned maintenance where possible.

8. AI-Generated Content

Plans, stories, and other content generated by Forevibe's AI are provided as recommendations and guidance. Important disclaimers:

• AI-generated plans are suggestions, not guarantees of completeness or correctness
• You are responsible for reviewing and validating all generated content before implementation
• We do not guarantee that following generated plans will result in a successful product
• Security recommendations should be validated by qualified security professionals

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of your data as described therein. We do not train AI models on your product data.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Forevibe LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Forevibe LTD from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow for data export, after which it will be permanently deleted in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or prominent notice in the application at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer based in the EEA or Northern Ireland, you may also have the right to rely on the mandatory provisions of the laws of your country of residence.

15. Data Usage Policy

Forevibe processes your data in accordance with our commitment to privacy and security:

• No AI Training: Your product ideas, plans, and content are never used to train AI models
• Data Minimisation: We only collect data necessary to provide our services
• Secure Processing: All data is encrypted in transit and at rest
• Third-Party Limits: Data shared with AI providers is processed in real-time only, never stored for training
• Retention Limits: Inactive account data is automatically purged after 12 months
• Data Portability: Export your data anytime from account settings
